Terms and Conditions
TITLE TRANSFER All sales are F.O.B. (Freight on Board) factory and title to the shipment passes to you once your shipment is loaded on the truck at factory. We are not liable thereafter for any loss of the shipment, or damage to, or caused by the shipment after it is loaded on the truck at factory. Any claims for loss after the shipment is loaded at factory will need to be filed by the customer directly with the freight company.
LIABILITY TRASSIG CORP shall not be liable for incidental, indirect, special, or consequential damages. In no event will TRASSIG CORP be liable for damages beyond the invoiced price.
WARRANTY – TRASSIG CORP does not express or imply any warranty. All items are warranted by the manufacturer. Each manufacturer offers different warranties for different products. Please contact us for details about specific products. TRASSIG CORP expressly disclaims liability for any injury, loss, or damage arising from the use or inability to use an item sold by us. Our only obligation is to replace an item that is delivered defective and this obligation is limited.
RETURNS – Most of our products are made to order to customer’s design and/or color specifications. No returns will be accepted for these custom items. Returns will be accepted for only a very limited selection of items which are considered stock items and only with prior authorization from TRASSIG CORP within 30 days of delivery acceptance. Customer is responsible for original freight charges and return freight charges. All returns are subject to a 30% restocking fee. No returns will be accepted for products once they have been installed.
CANCELLATION – All orders are subject to a 30% cancellation fee. This fee will apply if you cancel your order or change your color choice after your order is placed. No cancellations are allowed on orders that have shipped.
JURISDICTION – All disputes shall be governed by the laws of Connecticut and shall be heard in Connecticut.
CHANGES SPECIFICATIONS/PRICING – All photos/specs/pricing are accurate at time of printing. However, due to changing market conditions and continual improvement in designs, we reserve the right to change designs, specifications, and pricing without notice.
UNLOADING OF FREIGHT: Unless otherwise specifically stated, it is the customer’s responsibility to unload their freight shipments from the truck. Shipments will be delivered to or as close to your property line and or driveway provided the location is deemed assessable by the delivering carrier. Please tell us at the time of purchase of any unusual or difficult location or delivery issues, so necessary arrangements may be made with the delivering carrier, where possible. There may be additional shipping costs depending on your specific situation. The driver is not obligated to help you unload your freight (although some will), so be sure to have 1-2 people there to help you unload.
DAMAGED SHIPMENTS: Occasionally, shipments will get damaged during transit. All merchandise must be inspected prior to signing acceptance from the carrier. If any damage is found, IT MUST BE NOTED ON THE DELIVERY RECEIPT. We cannot file a claim with the freight carrier if it is not noted and in such case, we cannot be responsible for any damage not noted on the delivery receipt. If you cannot inspect the merchandise, please note on the delivery receipt any damage noticed on the packaging itself.
MISSING PARTS: All missing parts must be reported to us within 10 days of your receipt of your order. We will not replace any parts that are not reported within that 10 day period.
